RegisterLevi Barrett, co-managing partner of Peckar & Abramson’s New Jersey office, and chair of the firm’s Contracts, Project Documentation and Risk Management practice, will participate in the panel discussion, “Construction Contracting Revisited: The Three Rs and How Owners Want You to Negotiate,” at the Associated General Contractors of America (AGC)’s 2022 national convention.
The presentation will focus on a philosophical approach to contract negotiation that encourages positive collaboration between the parties and avoids common mistakes like pushing contract revisions too early or delegating negotiation to attorneys/legal departments. Building off an initial presentation in September 2021, this second iteration will apply an Owner’s perspective on how they wish to be engaged and how to build their confidence to better win work. Once key points are established, the panel will explore several common contract negotiation issues/clauses (e.g., form of contract, material escalation clauses/supply chain risk, liquidated damages and waiver of consequential damages, indemnity/defense obligations, compensation issues related to COVID-19, force majeure issues, and other important provisions) with Owner perspective on what they want to hear to communicate that a contractor has “win-win” in mind.
Levi will join panelists Dan Garcia, Associate General Counsel at Meta; Bryan Kelley, VP-Legal at Howard S. Wright, a Balfour Beatty company; and Kristen Wendler, Lead Solicitor Counsel at JV Driver, for the discussion which will take place on Wednesday, March 30 from 9:30am to 10:30am CT. The convention will take place March 28 to March 31 at the Gaylord Texan Resort & Convention Center.
