This panel will examine key factors when drafting a construction contract’s arbitration clause. Leaving out critical language to address issues such as jurisdiction, standing, and the scope of the arbitration clause can force parties into court, cause delays, and significantly increase the overall cost. The upfront planning of the arbitration clause, especially when multiple parties are anticipated, is essential to ensure a fair and efficient dispute resolution process for parties, their counsel, and the arbitrators.
