Edward O. Pacer will be speaking at the American Bar Association 2015 Business Law Section Annual Meeting September 17 – 19, 2015 at the Hyatt Regency Chicago, Chicago, Illinois. Mr. Pacer will participate in a round table discussion on Friday, September 18, 2015 titled, “The Independent Monitor – Ally or Adversary to the Corporation?” The discussion will focus on what concerns a corporation should have when dealing with a situation that involves a monitor as the result of a court order, deferred prosecution agreement, or non-prosecution agreement. The discussion will also focus on the role and concerns of the prosecutor, the monitor and the corporation. Specifically, the panel will focus on the scope of the monitors role, the qualifications of the monitor, the monitors reporting duties, and the balance between a corporation’s duty to cooperate with the monitor while still protecting its ongoing ability to operate.
