The presentation titled “Notable Pending Legislation: Proposed Amendments to Chapter 558, Florida Statutes” will discuss Chapter 558 Florida Statutes and the amendments proposed by HB 87 and SB 418; and the current status of the pending legislation. The Florida Legislature enacted Chapter 558, Florida Statutes, as an alternative dispute resolution mechanism to resolve construction defect disputes, in an effort to reduce the number of construction defect lawsuits and to reduce the associated costs of litigation, while at the same time protecting the rights of property owners. House of Representatives Bill 87 and related Senate Bill 418 proposed several key amendments to Chapter 558, with the goal of ensuring that recipients of Chapter 558 Notices of Construction Defects can proactively and effectively address alleged construction defects and avoid costly litigation.
