Greene, Jr., of Peckar & Abramson’s New Jersey office, will participate in a webcast for the Association of Corporate Counsel titled “Tips to Know Before Negotiating a Construction Contract Abroad.” The speakers will analyze how contracting issues abroad differ based on the jurisdiction (civil vs. common law) and whether the project is public or private, which will be addressed by a general overview and examples. The speakers will also briefly discuss the limitation of liabilities, force majeure, differing conditions, the types of dispute resolution mechanisms that are typically followed (basically arbitration) and how an appropriate international arbitration clause should be drafted (including forum, venue, seat, and selection of arbitrators). The webcast will take place on Tuesday, May 8 from 12:00 PM to 1:00 PM.
About the Webcast
This presentation will be an overview of International Construction Contracting. The target audience is U.S. contractors doing business, or looking to do business, abroad. The focus will be on the transactional contracting side, addressing issues of risk inherent in such projects that differ from what contractors expect contracting in the U.S. and how to deal with those issues from a contracting standpoint (e.g. scope, price, payment and performance security, contract forms typically used, etc.).
