Charles F. Kenny, Co-Managing Partner in the firm’s New Jersey office, whose background is in construction contracts and legislation affecting the construction industry, accurately predicted that the New Jersey Supreme Court would uphold the appellate court’s ruling, citing how the construction lien law can be adapted to fit new and unorthodox situations. In a story in the Construction Section of Law360 published on September 18, 2018 entitled “NJ Justices Side With Unpaid Demo Firms In Salvage Suit”, the high court sided with unpaid demolition companies in a dispute over a leveled power plant, confirming that the market value of salvaged material can be used to pay what the companies are owed for their work. In a one-page ruling filed on September 12, 2018, the high court denied the petition filed by NRG Rema LLC and BTU Solutions Group LLC and declined to hear their appeal.
