Eric Gruzen Authors Article on Mann Report

Eric Gruzen authored an article titled “Misconceptions About Attorney-Client Privilege” that recently appeared on the Mann Report Management website. The article focuses on Attorney-Client Privilege which is commonly misunderstood, especially when contained in e-mail communications and/or other written correspondence. The fact that an attorney is merely copied on an e-mail communication and/or correspondence does not necessarily constitute attorney-client privilege. An attorney-client relationship must first be established. For example, a client is a person who consults with a lawyer seeking legal advice and representation. However, when a lawyer acts as a negotiator for the client by providing business advice, the lawyer may then be classified as a business agent. For example, in-house counsel may conduct non-legal functions and this may be done without necessarily jeopardizing the attorney-client privilege.
