Michael C. Zisa co-authored an article titled “Alternative Project Delivery, Alternative Risks – Are Construction Managers More at Risk?” that appeared in the National Association of Surety Bond Producers (NASBP) Fall 2015 magazine. The article discusses the lines of responsibility that have been blurred by alternative project delivery methods such as “design-build” and “construction manager at-risk.” As project delivery methods change so do risks for contractors who assume these alternate and expanded roles. A Massachusetts Court trial court and subsequent appellate decision highlights the potential risks for a Construction Manager At-Risk. This article provides an overview of the courts’ opinions, the industry wide implications, and methods for addressing and mitigating the resulting risks.
