Nick Hoogstraten authored an article that appeared in The Washington Building Congress Bulletin June/July 2015 publication. The article titled “A Hard Rain Is Gonna Fall: Construction Stormwater Permitting under the Clean Water Act in the District of Columbia, Maryland and Virginia” is a primer on Clean Water Act NPDES permitting for stormwater discharges from construction sites in Maryland, Virginia, and the District of Columbia. The article discusses which projects and parties require NPDES permit coverage, how NPDES permit coverage is obtained, and when and how NPDES permit coverage may be terminated. The similarities and differences in the administration of NPDES permitting in the three jurisdictions are highlighted.
