Richard T. Preiss, Partner in Peckar & Abramson’s New York office, participated in a panel discussion at the 29th Annual Meeting of the American College of Construction Lawyers (ACCL), February 22 – 25, 2018 at the Monarch Beach Resort in Dana Point, CA. Mr. Press’s session titled “Investigations in the Construction World – Who is Watching?” focused on enforcement arms of the multilateral development banks – which operate under international law and have significantly stepped up enforcement in the construction industry with consequences that can include cross-debarment across all development banks and multiple countries as well as criminal prosecution. The panel discussed what steps can domestic and international construction companies take to minimize the risks of these kinds of problems and what advice do you give if a client becomes the subject of a domestic or multijurisdictional investigation.
